At SoftWaring Solutions ATF The Miss Trust (herein SoftWaring Solutions), we are committed to protecting your privacy as a user of our apps and websites. We use the information we collect about you to maximize the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our privacy policy below carefully.

You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. SoftWaring Solutions’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. We do not collect nor store Credit Card information.

STORAGE AND SECURITY OF YOUR INFORMATION

We may use personal information collected from you for the purpose of providing the functionality offered by our services and to provide necessary updates regarding our services. If you wish to cease receiving any such information you may let us know either by email or unsubscribing at any time and your request will be actioned immediately.

Personal details are are not used for any other purpose. Details are only supplied to a third party supplier when it is required by law, for goods or services which you have purchased or requested, when you have authorised a service provider with access, or to protect our copyright, trademarks and other legal rights.

We respect the privacy of our users. We may collect information on or through this website, web application or mobile application services that can personally identify you. For example, we collect personally identifiable information which you volunteer to us to create an account, or provide feedback (“Personal Data”).

We will use all reasonable means to protect the confidentiality of your Personal Data while in our possession or control. We will not knowingly share any of your Personal Data with any third party other than our service providers who assist us in providing the information and/or services we are providing to you. To the extent that we do share your personal information with a service provider, we would only do so if that party has agreed to comply with our privacy standards as described in this privacy policy. Some of our service providers may be overseas and may not be subject to Australian Privacy Laws. Please contact us if you require specific details.

Any non-personal information, communications and material you send to this website or to us by email, or which we obtain from third parties without promises of confidentiality, may be kept, used and disclosed by us on a non-confidential basis. We are free to use and reproduce any such information freely, and for any purpose whatsoever. Specifically, we will be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose, including developing, manufacturing or marketing products.

We offer three services by which you can voluntarily provided use your data:

inMotion Website

The following information may be collected by users of the inMotion Website:

  • Data submitted through our 'Contact Us' form including your name, email address and the enquiry details.
  • Web requests are logged on our servers for the purpose of site administration, identification of potential security threats and diagnose problems. Information collected includes timestamp, requested action (GET, POST, etc), requested URL, originating IP address, and requestor type (e.g. browser type).

inMotion Application

The following information may be collected by users of the inMotion Web Application:

  • As part of signing up for an account, we require users provide a unique username, valid email, first and last names and confirm they are 'Not a Robot' using a Google managed captcha. This information is used to create and login to the account. Please note:
    • The email will be used to notify the user of significant events, such as a password reset, change of password and membership changes. We may also use the email to contact the user directly, for the purposes of informing them of significant changes to the services provided. We do not share or sell the personally identifiable information to any third parties.
    • During sign up or as part of modifying user settings, a user may elect to make their username 'publically visible'. This means, that other inMotion users can lookup the name when adding members to their account. The user may modify the public nature at any time. However, please note once shared the name maybe known by others. If the user wished to anonymise their username then they should change it to sometime else.
  • Data maybe imported into the inMotion Web Application:
    • inMotion Mobile App - Automatically uploaded from inMotion Mobile Application (see below)
    • File upload - Uploaded as files by an authenticated user within the web application:
      • Tracks - GPX and CSV
      • Coverages - ESRI compatible Shapefiles and GeoJSON
    • Programatically - Direct integration using the inMotion API or Python SDK. This may require the creation of a Dev Key and API Key, managed and controlled by an account administrator using the inMotion Web App.
  • If authorised, inMotion users may choose to share their data with other users in two ways:
    • Public Sharing - An account owner or administrator may choose to publically share an activity publically. This is done in the form of a URL which can be published into X, Facebook or emailed. Integration with X and Facebook are light-touch simply providing the URL and title to the relevant service. The user must choose whether to publish the URL. The user may choose to stop sharing the activity at any time.
    • Private Sharing - An account owner may choose to add / remove other inMotion users as members to their account. This will give access to ALL data in the account, although the owner can select whether the member can view, modify, or administer the shared account.
  • Web requests are logged on our servers for the purpose of site administration, identification of potential security threats and diagnose problems. Information collected includes timestamp, requested action (GET, POST, etc), requested URL, originating IP address, and requestor type (e.g. browser type).

inMotion Mobile Application

The purpose of the inMotion Mobile Application is to allow authorised users to captured track based activities (e.g. runs, bike ride, car trips) which can be automatically uploaded to the inMotion Web Application for long term storage and review.

All data is initially stored within a secure area on the mobile device, only accessible to the application and authorised user. You may delete all stored data by using Clear Activities within the Settings menu, deleting downloaded routes / maps. To delete a cache of your user name to improve login, you will need to delete the application and associated data using the Mobile Operating System.

The following information is collected and uploaded:

  • Track Location - As the user performs an activity, the inMotion Mobile App will capture a sequence of timestamped locations (latitude, longitude and altitude) that track where the activity was performed. Speed, direction, gradient and distance are derived from the location data and not independently collected.
  • Bluetooth Sensor Data - inMotion can be integrated with a limited selection of Bluetooth devices, specifically Heart Rate sensors. If a wearable HR sensor is configured, the collected data will be associated with the track locations and uploaded at the same time.
  • Device Details - When an activity is started, information about the device is collected and stored as attributes of the activity. This includes the name of the device, the device type (e.g. iPhone), the operating system (e.g. iOS), operating system version, and version information about the Titanium, the Mobile Application framework used to develop the inMotion Mobile App.

Further the inMotion Mobile Application can download authorised Coverage and Route data previously uploaded to web application.

COOKIES

A cookie is a small file placed in your web browser that collects information about your web browsing behaviour. Use of cookies allows a website to tailor its configuration to your needs and preferences. Cookies do not access information stored on your computer or any personal information (e.g. name, address, email address or telephone number). Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. This may, however, prevent you from taking full advantage of our website.

Our website and Web Application only use cookies to ensure our website and apps communicate securely and for the purpose of 'remembering' choices such as the currently selected account. We do not currently use cookies for the purpose of tracking a user actions, for marketing, or for the purpose of selling to a third party.

DISCLOSURE OF YOUR INFORMATION

We may from time to time need to disclose certain information, which may include your Personal Data, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. Also, we may use your Personal Data to protect the rights, property or safety of SoftWaring Solutions, our customers or third parties.

If there is a change of control in one of our businesses (whether by merger, sale, transfer of assets or otherwise) customer information, which may include your Personal Data, could be disclosed to a potential purchaser under a confidentiality agreement. We would only disclose your information in good faith and where required by any of the above circumstances.

THIRD PARTIES

We do not and will not sell or deal in personal or customer information. We will never disclose your personal details to a third party except the necessary information required by providers of products or services you have purchased or requested, when you have authorised access to a service provider, or to protect the rights, property or safety of SoftWaring Solutions, our customers or third parties or if required by law.

We may however use in a general sense without any reference to your name, your information to create statistics and data products, identify user demands and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve our apps, websites and services but not for any other use.

SECURITY

We strive to ensure the security, integrity and privacy of personal information submitted to our websites and apps, and we periodically update our security measures in light of current technologies.

Our websites and apps may contain links to other websites. These links are meant for your convenience only. Links to third party websites do not constitute sponsorship or endorsement or approval of these websites. Please be aware that we are not responsible for the privacy practices of such other websites. We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personally identifiable information. This privacy policy applies solely to information collected by softwaringsolutions.com, inmotion.io, inMotion APIs and SDKs and inMotion mobile apps.

As we plan to ensure our privacy policy remains current, this policy is subject to change. We may modify this policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on this website.
